The 9th Circuit Court of Appeals has confirmed that Katy Perry's "Dark Horse" does not infringe on Flame's "Joyful Noise". Flame had claimed copyright ownership of an "eight note ostinato" that sounds similar in both works. When a jury agreed with Flame, the judge intervened, ruling that the ostinato does not meet copyright's "originality" requirement.
