Show Part 1 of 2 The Politically Incorrect Guide to the Constitution. Kevin R. C. Gutzman (Author)

This is an audio excerpt from the book. Chapters 1-3.

Purchase audio book from Audible or buy the audio book on cd's from amazon or barnes and nobel then donate it to your local library.

Book Description

The Constitution of the United States created a representative republic marked by federalism and the separation of powers. Yet numerous federal judges--led by the Supreme Court--have used the Constitution as a blank check to substitute their own views on hot-button issues such as abortion, capital punishment, and samesex marriage for perfectly constitutional laws enacted by We the People through our elected representatives.

Now, The Politically Incorrect Guide(tm) to the Constitution shows that there is very little relationship between the Constitution as ratified by the thirteen original states more than two centuries ago and the "constitutional law" imposed upon us since then. Instead of the system of state-level decision makers and elected officials the Constitution was intended to create, judges have given us a highly centralized system in which bureaucrats and appointed--not elected--officials make most of the important policies.

In The Politically Incorrect Guide to the Constitution, Professor Kevin Gutzman, who holds advanced degrees in both law and American history:

* explains how the Constitution was understood by the founders who wrote it and the people who ratified it * follows the Supreme Court as it uses the fig leaf of the Constitution to cover its naked usurpation of the rights and powers the Constitution explicitly reserves to the states and to the people * shows how we slid from the Constitution's republican federal government, with its very limited powers, to an unrepublican "judgeocracy" with limitless powers * reveals how huge swaths of American law and society were remade in the wake of Supreme Court rulings * reveals how the Fourteenth Amendment has been twisted to use the Bill of Rights as a check on state power instead of on federal power, as originally intended * exposes the radical inconsistency between "constitutional law" and the rule of law * contends that the judges who receive the most attention in history books are celebrated for acting against the Constitution rather than for it

As Professor Gutzman shows, constitutional law is supposed to apply the Constitution's plain meaning to prevent judges, presidents, and congresses from overstepping their authority. If we want to return to the founding fathers' vision of the Republic, if we want the Constitution enforced in the way it was explained to the people at the time of its ratification, then we have to overcome the "received wisdom" about what constitutional law is. The Politically Incorrect Guide(tm) to the Constitution is an important step in that direction.

Thank you so much!Joe Biden's presidential campaign, in a bid to broaden its appeal with younger voters and small donors, has turned to a data science software and consulting company backed by former Google chairman Eric Schmidt, CNBC has learned. The firm, Civis Analytics, has been advising Biden's team on how to better connect with young voters online and improve its appeal to donors who give $200 and less, according to those familiar with the matter. Civis, which was founded in 2013 by former President Barack Obama's 2012 campaign analytics chief, Dan Wagner, has also suggested potential digital hires for Biden's 2020 campaign, these people added.Schmidt, who backed Obama, is part of a host committee for a May fundraiser for Biden at the Los Angeles home of James Costos, the former U.S. ambassador to Spain under Obama. Federal Election Commission records show Schmidt has donated at least $2,800 to Sen. Cory Booker's campaign for president. He has backed Republicans, as well. People close to Schmidt insist he has not participated in consulting for Biden or any 2020 Democrat that has hired Civis. "Eric has not endorsed any candidate and is not working with any campaign right now. He is a board of member of Civis- which is providing these types of services for all types of Democratic candidates," one person said on the condition of anonymity.Federal Election Commission records show former Texas Rep. Beto O'Rourke $9,000), Sen. Elizabeth Warren ($9,500) and Booker ($19,000) paid Civis during the first quarter of 2019 for a range of tasks, including research consulting and database services.During the 2018 congressional midterm elections, Democratic super PACs paid Civis hundreds of thousands of dollars. The Senate Majority PAC, which is dedicated to helping Democrats win their respective Senate races, spent $2.2 million, while the House Majority PAC, a committee backing candidates for the House of Representatives, paid Civis $418,000, according to the nonpartisan Center for Responsive Politics. Meanwhile, the Democratic National Committee gave $185,000 to the company.Last November, Democrats retook the majority in the House while losing some seats in the Senate.Representatives for Civis, the Biden campaign and Google declined to comment. Schmidt, through a spokesman, also declined to comment.Schmidt is a technical advisor at Google's parent company, Alphabet, and has a net worth of $14.3 billion, according to Forbes. Schmidt was Alphabet's executive chairman from 2015 through 2017.He also had strong ties to Obama when he was president. Schmidt visited the White House 18 times from 2009 to 2015, according to data collected by the nonpartisan Campaign for Accountability. Four of those meetings were with Obama himself. In 2012, he donated $35,800 to Obama's joint fundraising committee, the Obama Victory Fund.Going into Biden's 2020 run, his supporters privately warned him that he needed to improve his online presence if he wanted to overtake other candidates who had more experience appealing to young voters through social media.Biden then met with an executive from Twitter and spoke with Athan Stephanopoulos, president of NowThis News, which specializes in viral short-form videos — and helped raise the national profile of O'Rourke when he ran for a U.S. Senate seat in Texas, CNBC previously reported.Since then, Biden's campaign has hired at least one digital advisor. PJ Alampi, a former director of accounts at multi-channel network Fullscreen Inc., recently became the campaign's head of digital strategy. Alampi was also was a social media strategist at Epic Signal, a digital marketing company, according to his LinkedIn page.During the first week of his campaign, Biden's team spent $406,860 on Facebook ads, according to data compiled by the social media companies' Ad Library Report. In contrast, President Donald Trump's joint fundraising committee, Make America Great Again, invested just over $159,000 on Facebook ads during the same time period.

Thank you so much!South Bend, Indiana, Mayor Pete Buttigieg on Tuesday shut down his political action committee as he looks to continue gaining steam in a Democratic primary field where some of the biggest names have sworn off donations from PACs.The Hitting Home PAC, which Buttigieg launched in June 2017 following his failed bid to become chair of the Democratic National Committee, raised $403,503 and spent nearly all of it — $399,267 — by the end of 2018, according to the Federal Election Commission.Buttigieg had used Hitting Home — a hybrid version of a super PAC and traditional PAC — to send donations of up to $2,000 mostly to Democrats running for Congress in Republican-held districts, according to the Center for Responsive Politics. The PAC spent $37,000 on those candidates in the 2018 cycle. In a termination report filed Tuesday, the PAC reported raising nearly $6,000 in contributions in 2019. "We've been winding down the PAC for a while, and as of today we filed the termination papers," said Chris Meagher, national press secretary for Buttigieg's 2020 campaign.By far the biggest contribution to Hitting Home came from Buttigieg's DNC election effort, which rolled $154,000 into the PAC in August 2018. But Buttigieg won hefty donations to the PAC from an array of prominent figures. The top single contribution of $50,000 came from Christel DeHaan, the German-born co-founder of Resort Condominiums International who was reportedly worth $940 million in 2018.Michael Browning, entrepreneur and chairman of the board of Browning Investments, chipped in $5,000 to the PAC. So did Robert Schiff of global consulting firm McKinsey & Company.Other donors included Indiana-based philanthropist Cynthia Simon Skjodt, whose father co-founded shopping mall giant Simon Property Group; Thomas Black, founding partner of law firm Black, Mann & Graham; and a former designer for social media network Pinterest. In the 2020 Democratic "money primary," many of the top contenders have already shunned PAC money.Democratic Sens. Elizabeth Warren of Massachusetts, Cory Booker of New Jersey and Kirsten Gillibrand of New York and independent Sen. Bernie Sanders of Vermont have all vowed to reject corporate PAC donations to their campaigns. So have former Senate candidate Beto O'Rourke of Texas, Sen. Kamala Harris of California and Rep. Tulsi Gabbard of Hawaii. In February, Warren took her pledge a step further, promising not to hold high-dollar fundraisers or make personal calls to wealthy donors to ask for their support. "My presidential primary campaign will be run on the principle of equal access for anybody who joins it," Warren wrote in a Medium post at the time. It's unclear if these pledges will make a difference in the race, however.Former Vice President Joe Biden, who has emerged as the clear frontrunner in recent opinion polls, attended a ritzy fundraiser in Pennsylvania on the same day he announced his campaign at the home of David Cohen, senior executive vice president of Comcast, the parent company of NBC News.Biden's campaign later announced it had raised $6.3 million in its first 24 hours, topping all other Democrats' day-one hauls.

Thank you so much!Lawmakers have introduced a bill that would make it easier for student loan borrowers to cancel their debt in bankruptcy. The measure, which is supported by 14 Democrats, one Republican and one independent, is dubbed the Student Borrower Bankruptcy Relief Act of 2019. "Americans struggling financially should have the option to discharge their student loans during bankruptcy as a last resort," said John Katko, R-New York. "This bipartisan legislation makes that change."A number of consumer advocacy groups, including Americans for Financial Reform, the National Consumer Law Center and the Center for Responsible Lending, praised the bill. "It's important to have legislation that will provide vulnerable student loan borrowers who cannot repay their debt with a pathway to reestablish their financial stability," said Cheye-Ann Corona, a senior policy associate at the Center for Responsible Lending. The country's outstanding student loan balance is projected to swell to $2 trillion by 2022, far surpassing credit card or auto debt, and experts say a large portion of it is unlikely to ever be repaid. More than a quarter of borrowers are in delinquency or default. Student borrowers owed $33,310 on average in 2018, according to the latest figures available from the Institute for College Access & Success. In the 1970s, policy makers and pundits raised concerns that students would rack up a bunch of loans and then try to discharge them after graduation. As a result, lawmakers added a stipulation that student loan borrowers would have to wait at least five years after they began repayment to file for bankruptcy. In 1990, that waiting period was upped to seven years. Almost a decade later, the rules changed again, and now people with federal or private student loans can walk away from their debt in bankruptcy only if they can prove their loans pose an "undue hardship."

Banned from social media and abandoned by some staff after inciting a riot at the U.S. Capitol, President Donald Trump and a dwindling circle of advisers plan a defiant final week in office, according to people familiar with the matter.

Trump is confident Vice President Mike Pence and members of his cabinet won’t attempt to remove him under the 25th Amendment, the people said. Pence is dismissive of the idea of trying to use that authority to drive Trump from office, one person said.

The president and some allies also believe Democrats are overreaching by trying to once again impeach him over Wednesday’s mob at the Capitol, and think Senate conviction would be unlikely in any event.

One adviser called Democratic consideration of impeachment a political gift to Trump. Pence hasn’t discussed the 25th Amendment beyond privately dismissing the approach as not feasible, according to a person familiar with the matter.

Trump and Pence haven’t spoken since Wednesday, though, when the vice president sheltered in place at the Capitol after the building was stormed by Trump supporters. Senator James Inhofe of Oklahoma told the Tulsa World newspaper he’d “never seen Pence as angry” as he was after being blasted by Trump for not intervening in the congressional count of Electoral College votes. Trump tweeted that Pence lacked “courage.”

US House Speaker Nancy Pelosi said on Sunday that she was ready to begin the second impeachment proceedings against US President Donald Trump if his cabinet fails to remove him from office under the 25th Amendment. The Democratic lawmaker said that the House will try to pass legislation on Monday urging Vice President Mike Pence to invoke the 25th Amendment and "declare the president incapable of executing the duties of his office." If that fails — which is considered the most likely outcome — Pelosi said that the House would move ahead with impeachment proceedings, although she did not say when that would be. "In protecting our Constitution and our Democracy, we will act with urgency, because this President represents an imminent threat to both,'' the House speaker said.

Trump, who is scheduled to leave office on January 20, has received sharp criticism following the violence in and around the US Capitol building on Wednesday. Trump has been accused of inciting the violence, by addressing a large rally on the National Mall in front of the US Capitol, saying he would join them when they "walk down to the Capitol" earlier that day. Since losing the Nov. 3 election, Trump has falsely claimed he was the victim of widespread fraud. House Speaker Nancy Pelosi told American broadcaster CBS in an interview that will air Sunday that "the person that's running the executive branch is a deranged, unhinged, dangerous president of the United States." Trump was previously impeached under two articles: abuse of power and obstruction of Congress in regards to allegations that Trump sought to discredit then-Democratic candidate Joe Biden in the lead up to the 2020 US presidential election. The articles were written up in 2019 and the trial was held in January 2020.
The Republican-controlled Senate did not find him guilty of either article. A two-thirds majority is required for a conviction.

US policy-making will be "chaotic" over the next term given Democrats have "run their campaign largely on the basis of Trump Derangement Syndrome", says former NSW Treasurer Michael Costa.

Mr Costa predicted factions within the Democratic Party would likely begin to turn on themselves without the unifying presence of President Trump.

"The glue that's held their party together has been Trump derangement and that's about to end," he said.

"Their left-wing is setting the political agenda and the right-wing is so Trump-deranged, it's allowed them to run with it.

"I have very little hope we're going to get a sound policy agenda."

Democrats have introduced an article of impeachment against President Donald Trump for his role in last week's deadly invasion of the Capitol.

The article filed in the House on Monday accuses Mr Trump of "incitement of insurrection".

Democrats say a vote on the article will go ahead in the House on Wednesday unless Vice-President Mike Pence invokes constitutional powers to remove Mr Trump from office.

Mr Pence is said to oppose the idea.

Calls for Mr Trump's resignation, removal from office or impeachment have grown among Democrats and some Republicans in the days following the riots in Congress in which five people died.

The impeachment resolution accuses the president of encouraging his supporters to storm the Capitol building at a rally in which Mr Trump alleged, without evidence, that November's presidential election was "stolen" from him.

One of Trump's most vocal defenders, Rep. Jim Jordan of Ohio, says the effort by Democrats to impeach President Trump is really about "canceling the president," and he warned "cancel culture will come for us all." (Jan. 13)

Democrats and a few Republicans say Trump must be removed immediately after he egged on a violent mob of supporters a week ago who then stormed the Capitol. The insurrection happened as some of Trump's GOP allies were challenging his election defeat, echoing the president's false claims that there was widespread fraud in his loss to Democrat Joe Biden.

But many Republicans argue impeachment is divisive and will not unite the country in this trying time.

Republican Rep. Jim Jordan of Ohio, one of Trump's most vocal defenders, said Wednesday Democrats "have an obsession" with impeaching President Trump.

"It's always been about getting the president, no matter what," Jordan said on the House floor.

He said Democrats are really out to "cancel the president and anyone who disagrees with them." And he warned that "cancel culture will come for us all."
